The decision, based on National Policy 11-206 and section 1(10)(a)(ii) of the Ontario Securities Act, was influenced by several key factors: Athabasca Minerals Inc. is not an OTC reporting issuer, has fewer than 15 securityholders in each Canadian jurisdiction and fewer than 51 worldwide, and its securities are not traded on any marketplace. Additionally, the company is not in default of any securities legislation. The Alberta Securities Commission acted as the principal regulator, and the order also applies in British Columbia under MI 11-102.
