In this Part and the Schedule to this Act, references to the “emergency” and “declared emergency” are references to the emergency declared pursuant to Order in Council 518/2020 (Ontario Regulation 50/20) on March 17, 2020 pursuant to section 7.0.1 of the Emergency Management and Civil Protection Act and, for clarity, those references include any extension of the emergency under section 7.0.7 of that Act.

Section 280
Application of Schedule, Temporary Suspension Period
(1) The sections of the Schedule to this Act apply during the temporary suspension period, as described in subsection (2) for each section.
(2) The temporary suspension period, as referred to in each section of the Schedule to this Act, is the period of the emergency and a further period that ends on the 120th day after the day the declared emergency is terminated [Lexata note: the emergency was terminated on July 24, 2020] and, if the regulations so provide for the section, a further prescribed period of time immediately following the end of the 120-day period.

The Schedule to the OBCA was added on March 17, 2020 in response to COVID-19. The Schedule temporarily amends certain provisions relating to shareholders’ meetings. See Section 94 and Section 103 for details. Under OBCA Regulation 542/20, the changes are effective until September 30, 2022.
